Terms and Conditions

Updated 30 October 2026

1 Seller and contact

These terms govern use of www.andapenguin.co.za and purchases made directly from Anda Penguin (Pty) Ltd, registration number 2026/368271/07. Address: 145 Albertyn Road, Kyalami Hills, Gauteng, 1685, South Africa. Contact: [email protected]; 063 620 8216.

2 Adults and supervised learning

Purchases and membership agreements must be made by an adult with authority to enter into them. Children may use learning resources with appropriate adult supervision. Resources support language learning and enjoyment; individual learning outcomes are not guaranteed.

3 Products prices and orders

The product description states the format, contents, price, access period and any compulsory charges before an order is placed. Prices are in South African rand unless expressly stated otherwise. Any applicable taxes and compulsory charges must be shown before payment. Customers must have an opportunity to review and correct an order before submitting it. Keep your order reference and payment confirmation for support.

4 Payment and delivery

All products currently offered are digital downloads; no physical items are shipped. Payments offered through PayFast are processed by PayFast. Download access is provided only after payment has been confirmed. The product page and checkout will explain the delivery method, timing, file format and any access limits before purchase. If payment succeeds but you cannot access your files, contact [email protected] with your order reference. We will assist with access or an applicable refund. We will notify customers of material delays and cancellation options.

5 Memberships

Funda Nathi costs R85 per month and includes available printable posters, flashcards and selected workbooks (currently Fruits and Vegetables). Khula Nathi costs R170 per month and includes those resources, the full available printable library, all interactive Play flashcards and finished iintsomi listed in the member library. An adult must create and verify an account and expressly agree to recurring billing before payment. PayFast collects the initial payment and monthly card renewals until cancelled. The next billing date is set to the corresponding date in the following month, using its last day where needed. Access starts only after a successful payment has been verified. Downloaded files remain subject to the personal and family use licence. New resources are added as they are published; no fixed release frequency is promised. Stop future renewals using Cancel future renewals in your member account. Cancellation is confirmed only when PayFast confirms it; paid access remains until the displayed end date. If cancellation cannot be completed online, contact [email protected] promptly. Failed renewals do not extend paid access. Refund and statutory rights are explained in the Refund and Cancellation Policy. Purchases made separately on Patreon remain subject to the terms disclosed there.

6 Use of learning material

Unless a product expressly grants a different licence, purchased or free resources may be used for personal, non-commercial learning within the purchaser’s household. A school or organisation should request an appropriate licence before wider use. Do not resell, redistribute, publicly upload or misrepresent ownership of Anda Penguin material. Applicable statutory exceptions remain available.

7 Fair use availability and responsibility

Do not interfere with the website, attempt unauthorised access or use it unlawfully. We aim to keep the service available and information accurate, but maintenance and interruptions may occur. Nothing in these terms excludes liability or limits a remedy where South African law does not permit it, including applicable consumer rights.

8 Privacy cancellations and disputes

The Privacy Policy and Refund/Cancellation Policy explain data handling and purchase remedies. Send complaints to [email protected] with your order reference. South African law applies without limiting mandatory protections or access to regulators and courts. Changes apply prospectively; existing purchases remain governed by their agreed terms.
